The constitutional court is asked to review the constitutionality of law n°2004-037 authorising ratification of the 1973 International Convention for the Prevention of Pollution form Ships (MARPOL 73/78) and its annexes.

The object of the law has a legislative nature under article 82.3, VIII of the Constitution.

The National Assembly and the Senate properly adopted the law. The provisions of the law and the MARPOL Convention comply with the Constitution. Consequently the Court ruled that the law and the MARPOL Convention are constitutional.
