Abstract

The defendants were engaged in the hydrochloric acid cleaning feldspar granule project in a workshop located in Xiaoshuizhuang Village, Zuocun Town, Laizhou City, without any registration, safety inspection, environmental assessment, or other procedures. Approximately 60 tons of waste acid were generated during such an operation, which was initially stored in a wastewater pool outside the north wall of the compound. During the storage period in the wastewater pool, there were evident signs of leakage, resulting in pollution of the soil and surrounding water. Both defendants were found guilty of the crime of environmental pollution, fined and sentenced to time in prison.

As well as the criminal proceedings, in the civil litigation, the Intermediate People's Court of Yantai City of Shandong Province ordered the defendants to dispose of the contaminated sand, bear the cost of acid washing hazardous waste disposal and formulate and carry out a restoration plan (and if this is not carried out or does not meet the requirements, to pay compensation).
