Abstract

The defendants illegally excavated construction sand on contracted land, resulting in the complete destruction of the original ecosystem and damaging its service capacity. The Fourth Branch of the People's Procuratorate of Beijing Municipality initiated the environmental civil public interest action against the defendants for illegal excavation, causing soil damage and damage to ecology and environment. The criminal part of the case was tried separately. The defendants undertook restoration work in compliance with the law.

In the civil proceedings, The Fourth Intermediate People's Court of Beijing Municipality ordered the defendants to restore the ecological and environmental damage, which was recognized as having been completed; compensate for the loss of service function, offset by the cost of disposing of construction waste; pay an appraisal fee; apologize to the public.
