Caught in the act hunting – permanent reservation – prohibited time for hunting – prohibited hunting tools - effect of the incident report – not specifying annulment reason.


The appeal court is allowed to support arguments of the first instance court if these arguments are consistent and in accordance with the law. The contested decision when supported the first instance court it adopted its justifications and reasoning and that the supported decision relied on the suspect’s confession in the police report, and on the fact of being caught hunting inside a permanent reservation in a prohibited time and with prohibited tools. The court relied on a legal means for proof and implicitly rejected what the appellant raised regarding the cancelation of the report because he did not specify a legal raison for that, and thus its decision is well justified and well grounded.
