Abstract

Respondents in the case wanted to construct a building. The applicants sought to cease the activity, so an injunction was granted to allow for the finding of evidence.

The applicants provided no evidence about the damage the construction would cause to the flora and fauna. There was also no evidence provided of any rare species. The respondents contended what was there could easily be replicated.

Therefore, the appeal was dismissed. The respondents could continue with the construction.
