Barbone and Ross (on behalf of Stop Stansted Expansion) v. Secretary of State for Transport Country/Territory United Kingdom Date Mar 1, 2009 Source UNEP, InforMEA Court name High Court of Justice Seat of court England and Wales Reference number [2009] EWHC 463 Abstract A United Kingdom court dismisses an application by the “Stop Stansted Expansion” group challenging the grant of planning permission relating to the increase in capacity of Stansted Airport under the Town and Country Planning Act 1990. Plaintiffs claimed that the government had, inter alia, failed to take into account the project’s effects on greenhouse gas emissions prior to granting the planning permission. However, the court held that the government had considered the impacts of the proposed development on climate change. Although the government is committed to tackling the problem of climate change and reducing greenhouse gas emission across the economy, this does not mean that every sector is expected to follow the same path.Key environmental legal questions:Citizen challenge to proposed airport expansion Full text climatecasechart.com
